Welcome to Mizwaj. These Terms of Service ("Terms") govern your access to and use of the Mizwaj mobile application, website and related services (collectively, the "Service"). By creating an account or using the Service you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old, or the legal age in your jurisdiction, to create an account. By using Mizwaj you represent that you have the legal capacity to enter into a binding agreement.
2. Your account
- You are responsible for the accuracy of the information you provide.
- You are responsible for maintaining the confidentiality of your credentials.
- Notify us immediately of any unauthorized access or use of your account.
- One person may not maintain multiple accounts without our permission.
3. The Service
Mizwaj is a marketplace that connects users with independent vendors offering services such as wedding halls, flowers, hospitality, entertainment, personal services and event organization. We are not the seller, manufacturer or provider of the products and services listed by vendors. Each vendor is solely responsible for the goods and services they offer.
4. Orders and payments
- Prices, availability and terms are set by vendors and may change without notice.
- By confirming an order you agree to pay the listed total, including any applicable taxes and delivery fees.
- Payments are processed by third-party providers; we do not store full payment card details.
- Orders are subject to vendor acceptance and may be canceled by the vendor or by Mizwaj for legitimate reasons (e.g., unavailability, payment failure, suspected fraud).
5. Cancellations and refunds
Cancellation, refund and rescheduling policies depend on the vendor, the product type (rent or buy) and the timing of the cancellation. The applicable policy is shown at checkout and may be reviewed in your order details. Where permitted by law, refunds are issued to the original payment method.
6. Delivery and tracking
For deliverable orders, an assigned driver will fulfill the delivery. You can track the order in real time within the app. You agree to provide accurate delivery information and to be reasonably available to receive the order.
7. "Send to a friend" orders
If you place an order to be delivered to a recipient other than yourself, you confirm that you have the right to share the recipient's contact information with us for delivery purposes and that the recipient has consented to be contacted in connection with the delivery.
8. Acceptable use
You agree not to:
- Use the Service for any illegal purpose or in violation of these Terms.
- Submit false or misleading information.
- Interfere with or disrupt the Service, servers or networks.
- Reverse engineer, scrape, or attempt to extract the source code of the Service.
- Harass, threaten or harm other users, vendors or drivers.
9. Intellectual property
All content, trademarks, logos and software associated with Mizwaj are owned by Mizwaj or its licensors and are protected by applicable laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.
10. User content
If you submit reviews, photos or other content, you grant Mizwaj a worldwide, royalty-free license to use, display and distribute that content in connection with the Service. You are responsible for the content you submit and warrant that it does not infringe any third-party rights.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Mizwaj does not warrant that the Service will be uninterrupted, error-free or that the goods and services offered by vendors will meet your expectations.
12. Limitation of liability
To the maximum extent permitted by law, Mizwaj and its affiliates will not be liable for indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Service. Our total liability for any claim shall not exceed the amount you paid through the Service in the 30 days preceding the claim.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, vendors, or Mizwaj. You may close your account at any time from within the app.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify you via the app or email. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance.
15. Governing law
These Terms are governed by the laws of the jurisdiction in which Mizwaj is established, without regard to its conflict of law principles. Disputes shall be resolved by the competent courts of that jurisdiction.
